The Ministry of Human Resources and Social Development has announced the launch of the second phase of adopting the “Notarized Employment Contract is an Enforceable Instrument". This phase covers fixed-term contracts upon their update or renewal upon expiration, as part of the Ministry’s efforts to enhance the reliability of contractual relationships and improve the efficiency of procedures related to safeguarding the rights of all parties.
The Ministry stated that this phase targets fixed-term contracts, with the transition to open-ended contracts scheduled for the third phase, providing establishments and workers with a gradual opportunity to adapt to the new procedures.
It further explained that benefiting from the enforceable instrument requires notarizing or updating the employment contract through the “Qiwa” platform and obtaining an execution number from the Documentation Center at the Ministry of Justice. In the event that a worker does not receive their full wage within 30 days from the due date, or receives it partially after 90 days, they may submit an electronic enforcement request via the “Najiz” platform. The employer is granted the right to object within five days from the date of notification.
The Ministry of Human Resources and Social Development emphasized the importance for all establishments to notarize and update employment contracts by logging into their establishment account on the “Qiwa” platform. The Ministry also urging all employers and workers to review the guidance manual available on its official website, which includes details of the regulations, procedures, eligible categories, and the application mechanism.
It is worth noting that the adoption of the Notarized Employment Contract as an Enforceable Instrument represents one of the developmental initiatives launched by the Ministry in partnership with the Ministry of Justice. This initiative aims to build a work environment based on clarity and transparency, and to enhance the confidence of all parties to the contractual relationship through digital tools that regulate obligations and proactively safeguard rights. It also contributes to reducing disputes, improving the quality of contractual relationships, and ensuring the fair and effective enforcement of rights.
