Article (16) bis (2) of the Executive Regulations of the Labor Law stipulates that, in order to implement Article (48) of the Labor Law:
(First) The employer has the right to terminate the training contract without compensating the trainee or the person subject to qualification in the event that the contract includes a provision to do so, unless the contract is terminated in accordance with one of the cases mentioned in Article (80) of the Labor Law, except for paragraph (6) thereof during the training or qualification period.
(Second) In the event that the employer does not comply during the training period with the rights of the trainee mentioned in the training contract, or the trainee is not able to obtain the necessary training, or the trainee has been abused in any way by an employer or employees of the establishment without taking the necessary action from the employer or his representative, the trainee may terminate the training contract without applying the provisions of the second paragraph of Article (48) of the Labor Law, provided that he notifies the training officer of the justification for terminating the contract.
(Third) The employer may oblige the trainee - after completing the training or qualification period - to pay the training or qualification expenses that have been spent on him or in proportion to the remaining period thereof, unless the training contract stipulates otherwise in the following cases:
1- If the trainee decides to terminate the training or qualification before the specified date without a legitimate excuse.
2- If the trainee or the person under qualification refuses or refrains to work for him for a period similar to the duration of the training or some of it.
3- If the training contract is terminated in accordance with paragraph (first) of this article.
Article (49) stipulates that (The provisions contained in this law regarding annual and official holidays, maximum working hours, daily rest periods, weekly rest, occupational health, work injuries and their conditions, and what the Minister decides shall apply to the qualification and training contract.
